Does Right on Red Require a 3-Second Stop?

Some Newsday readers wrote letters to Newsday regarding the red light camera situation and made some interesting points. Joy Ottaviano of Garden City said she stopped at a light, then proceeded to make a right on red. Eventually he was mailed a ticket, and a clerk told him he was required to stop at the light for a minimum of 3 seconds.

I’ve never heard of that, has anyone else?

    yes you have to make the 3 second stop before making a right on red. That is if no signs are posted stating otherwise.

    You may make a right turn at a steady red light after coming to a full stop and yielding the right-of-way to oncoming traffic and pedestrians. You may make a left turn at a steady red light when turning from a one-way road into another one-way road after coming to a full stop and yielding the right-of-way to oncoming traffic and pedestrians.

    Good point Bob, it doesn’t say anything there about a 3 second rule.

    Taking your idea, I checked the NY State Vehicle and Traffic Law website. It doesn’t have all the details but it seems to have covered what we’re talking about, and it doesn’t say anything about a 3 second rule either:

    Traffic facing a steady circular red signal may cautiously enter the intersection to make a right turn after stopping as required by paragraph one of this subdivision, except that right turning traffic is not required to stop when a steady right green arrow signal is shown at the same time. Such traffic shall yield the right-of-way to pedestrians within a marked or unmarked crosswalk at the intersection and to other traffic lawfully using the intersection;
